The Win 1 of 5 Gifts From The Heart Contest

Agreement: These rules govern the Win 1 of 5 Gifts From The Heart (the 'Contest'). No purchase is necessary to enter the Contest. The act of entering the Contest constitutes acceptance of the Contest rules and the decisions of the Contest judges, which decisions shall be final and binding upon all entrants. By entering, winner agrees that Metroland Media Group Ltd., their affiliates, partners, advertising and promotion agencies and suppliers and all of its respective officers, directors, employees, representatives and agents shall have no liability for, and shall be held harmless from and against any damage, loss or injury that may arise in whole or in part, directly or indirectly, from the acceptance, possession, use or misuse of prize (and any travel related hereto) or participation in this Contest.

Sponsor: The Contest sponsor is Flyerland.ca, a division of Metroland Media Group Ltd (the 'Sponsor').

Eligibility: The Contest is open to all residents of Canada excluding Quebec who are 18 years of age or older as of the first day of the Contest Period, except for employees, their immediate families and anyone living with any employee of the Sponsors or their corporate affiliates, advertising or promotional agencies. Incomplete or illegible entries will not be accepted and will be disqualified.

Contest: To enter the Contest, access the Contest website at www.flyerland.ca, read these Contest rules, and follow the instructions to enter during the Contest period (a valid email address will be required). The Contest opens at 12:00 a.m. EDT on Monday, November 2, 2009 and ends at 11:59 p.m. EDT on Tuesday, December 15, 2009 (the 'Contest Period'). This is an online Contest only and only entries submitted online by following the instructions on the Contest website will be eligible. You may enter the Contest only once by submitting the contest form online through the Contest website during the Contest Period. You may also receive up to an additional five (5) entries (one for each referral) if you refer a friend or family member to this Contest by entering the referral email address in the designated 'Five extra entries in this contest!' field found on the Contest form. The five potential winners will be chosen by random draw, which will take place at 10 Tempo Avenue, Toronto, Ontario on Wednesday, December 16, 2009. Each potential winner will be contacted by telephone or email by a representative of the Sponsor, and must reply within 48 hours to maintain eligibility. If a potential winner cannot be contacted within this time period or fails to respond to an attempted contact, such potential winner will be disqualified, his/her entry will be declared null and void and the Sponsor reserve the right, in their sole and absolute discretion, to select at random another eligible entry, in which event these provisions shall apply to such other eligible entry. In order to be eligible to win, each potential winner must correctly answer a mathematical skill-testing question, without assistance or mechanical or electronic aid.

Prize: Five (5) winners will receive one of the following five gifts from Gifts From the Heart:  Gift #1: Clearwater Life Experiences Lobster Feast for 12, consisting of twelve  1.5 pound lobsters (live or cooked) three pounds of Nova Scotia sea scallops, three pounds of Black Tiger shrimp, twelve eating kits (each kit includes: crackers, picks, bibs, wet naps),  all of which are shipped to a destination specified by the winner. Gift #2: A gift certificate for $500 worth of Merry Maid housekeeping services.  Gift #3: A gift certificate for $500 worth of  SpaDirect Life Experiences  spa services to be applied toward one of the following: Spa Bliss for the body 30 minute aromatherapy back massage papaya hand scrub orange vanilla hand massage, together with 15% off any additional Spadirect products or services; or a Spa Bliss for the feet aromatherapy foot soak spa pedicure botanical scrub and seated wellness massage, together with 15% off additional Spadirect products or services.  Gift #4: $500 worth of services from Chef Alliance Life Experiences  -Iron Chef for six. including a personal chef in your home for approximately two hours to create a delicious culinary creation using foods from your pantry. Gift #5: $500 gift certificate toward Fairmont life experiences.
Approximate retail value of all five prizes is $2500.00.   None of the prizes may be combined with any other coupon, vouchers, discount, bonus, upgrade, or other promotional offers. Prizes will be mailed to winning entrants.  Sponsor is not responsible for lost or misdirected mail.

Release: Prior to receiving a prize, each potential winner will be required to sign a declaration of eligibility and release form releasing the Sponsors and their related parties from any and all liability in connection with the Contest and/or the prize, confirming compliance with the rules and consenting to the use of his or her name and photograph, without further compensation, in any publicity carried out by the Sponsors and/or their advertising and promotional agencies. The signed form must be received by Sponsors within ten (10) days of issuance or the prize may be forfeited and awarded to an alternate entrant

Privacy: We use your personal contact information to administer this Contest, including contacting, announcing and promoting prize winners. Winner agrees that Flyerland may use winner’s name, picture, portrait, likeness, and voice for advertising and promotional purposes without compensation (whether in print, broadcast or electronic media In addition, we may use this information to send you offers or information from us, our affiliates and from selected sponsor or advertisers ('Marketing Offers').  Banning: The Sponsor may, in its sole discretion, prohibit any person from entering the Contest whom they believe to be abusing the rules. Such abuse includes entering false information and entering more times than permitted under these rules.

Other: Odds of winning depend on the number of eligible entries received. This Contest is governed by the laws of Ontario and the laws of Canada applicable therein and is void where prohibited by law. The Sponsor reserves the right to cancel or modify the Contest or the Contest rules at any time without notice. All prizes must be accepted as awarded and are not convertible to cash.  Sponsor reserve the right to substitute any prize with a prize of equal or greater value.  All prizes are awarded as is and no warranties or guarantees are implied or expressed.  The Sponsor is not liable for any lost, late, misdirected or stolen entries or inability to process entries, or any errors, damage or negligence that may arise in connection with this Contest, including technical failures on the website or Contest software, viruses, website disruptions, malfunctions or down-time, human error or property damage incurred by any Contest entrant. Sponsor is not responsible for any errors or omissions in printing or advertising this Contest. Use of any automated system including robotic or form filling software to enter or participate in this Contest is prohibited and will result in disqualification of all entries by anyone using such assistance. If a dispute arises regarding who submitted an online entry, the entry will be deemed to be submitted by the authorized account holder of the email address provided at time of entry. Authorized account holder is the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
